2. What we collect
- Contact details - name, email address, shipping address, billing address, phone number.
- Order details - items purchased, order number, sizes, payment status, shipping status, tracking, returns and exchanges.
- Payment information - processed by our payment providers. We receive confirmation of payment and the last four digits of the card. We never see or store your full card number.
- Account details - if you create an account: username, password, saved addresses and preferences.
- Communications - the content of emails and messages you send us.
- Device and usage data - IP address, browser and device type, pages viewed, and how you navigate the site, collected through cookies and similar technologies.
3. Why we use it, and on what legal basis
- To perform our contract with you - processing and shipping your order, handling returns, exchanges and refunds, and answering your questions.
- To comply with legal obligations - keeping invoices and tax records, and meeting customs and consumer law requirements.
- For our legitimate interests - preventing fraud and abuse, securing the website, and improving our products and service.
- With your consent - marketing emails and non-essential cookies. You can withdraw consent at any time.
4. Who we share it with
We share personal information only with parties who need it to deliver our service:
- Shopify, which hosts this store and processes orders on our behalf.
- Payment providers, to process your payment and screen for fraud.
- Suppliers and fulfilment partners, who receive your name, shipping address and phone number in order to pack and ship your order. Our products are shipped from outside Canada, including from suppliers located in China, so your delivery details are shared with them for that purpose.
- Carriers and customs authorities, including the Canada Border Services Agency, which may require shipment and recipient details to clear your parcel.
- Professional advisers and authorities, where we are legally required to disclose information.
We do not sell your personal information, and we do not share it for cross-context behavioural advertising in exchange for payment.
5. International transfers
We are based in the Netherlands and ship to customers in Canada, and our fulfilment partners are located outside the European Economic Area. This means your personal information is transferred internationally, including to countries that have not been recognised by the European Commission as providing an adequate level of data protection. Where that is the case, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses, and we limit the data shared to what is strictly necessary to deliver your order.
6. How long we keep it
We keep order and invoice records for as long as required by Dutch tax law, which is seven years. Account data is kept until you ask us to delete your account. Support emails are kept for up to two years. Marketing data is kept until you unsubscribe.
7. Your rights
Depending on where you live, you have the right to:
- access the personal information we hold about you;
- have inaccurate information corrected;
- have your information deleted;
- receive your information in a portable format, or have it transferred;
- object to or restrict how we process your information;
- withdraw consent at any time, without affecting processing that already took place;
- opt out of marketing, using the unsubscribe link in any marketing email.
To exercise any of these rights, email info@sophiemarietoronto.com. We reply within 1 business day and will handle your request within one month. We may need to verify your identity first.
If your browser sends a Global Privacy Control signal, we treat it as an opt-out request for that browser where applicable law requires us to.
8. Cookies
We use cookies that are necessary to run the store, such as keeping your cart and your session. We also use analytics and marketing cookies, which we only place with your consent. You can change or withdraw your cookie choices at any time through your browser settings or the cookie banner on our site.
9. Children
Our store is not intended for children, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.
10. Security
We take appropriate technical and organisational measures to protect your personal information. No method of transmission or storage is completely secure, so please do not send us sensitive information through insecure channels.
11. Complaints
If you have a concern about how we handle your data, please contact us first at info@sophiemarietoronto.com. You also have the right to complain to a supervisory authority:
- In the Netherlands and the EU: the Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl.
- In Canada: the Office of the Privacy Commissioner of Canada, priv.gc.ca, or your provincial privacy authority.
